The
canonical period known as the Ius Novissimum ran from the Council of Trent
(1545-1563) to the promulgation of the Pio-Benedictine Code (1917).
Beginning in the Renaissance, then, running through the Baroque and the discovery
of the New World, and reaching well into Modernity, this period saw some of
the greatest syntheses of canon law ever composed. The codification of canon
law in the early 20th century had the effect of discouraging research into
this period even though it was rich in social, pastoral, and legal insights.
Now that codified law
is firmly established in canonistics, it seems "safe" to begin revisiting some
of the classical works of the Ius Novissimum to mine them for the theoretical and
practical insights they offer.
For general overviews
of the Ius Novissimum, see: Alphonsus Van Hove,
Prolegomena ad Codicem Iuris Canonici,
2nd ed., (Dessain, 1945) at 383-407 (fontes) and 529-612 (scriptores);
Petrus Wernz, Ius Decretalium [see
below] I: esp. 423-459; and Consant Van de Wiel,
History of Canon Law (Peeters/ Eerdmans,
1991) 135-166.
For an overview of the underlying structure of the Ius Novissimum, see
Ius Decretalium.
